Modish Bear ("Modish Bear", "we", "us" or "our") runs the online store at www.modishbear.com (the "website"). We sell phone cases, tumblers, handbags and related accessories to customers in Australia.
You give us some information when you shop with us so we can deliver your order. This page describes what we gather, how we use it, who else can access it, and your rights.
Since Modish Bear is an Australian company, this policy complies with the Australian Privacy Principles and the Privacy Act 1988 (Cth). Some additional rights may apply to you if you live somewhere else; these are discussed near the end.

1. What "Personal Information" Means
Personal information is anything that points back to you. Your name, your delivery address, your phone number and your email are obvious ones. It also covers things you might not think of, like your IP address, the device you shop on, and a record of what you've bought from us.
Some information can't identify you by itself. A tally of how many people opened a product page, for instance, tells us nothing about who you are. Once information is grouped like that and stripped of anything personal, it stops being personal information, and this policy no longer limits what we do with it.

2. What We Collect
We pick up information in a few ways. Here's the whole list.
2.1 Things You Tell Us Yourself
Most of what we hold, you give us directly, usually because you're buying something or you need a hand. That happens when you browse and add items to your cart or wishlist, place an order, set up an account or sign in, message our support team, leave a review, join our newsletter or SMS list, enter a giveaway, or fill in any other form on the site.
Depending on what you're doing, that can include your name, your billing and delivery address, your email and phone number, the details of your order, and your buying history with us. It also takes in anything you write to us, and our replies, any review or photo you choose to post, and your account login. We store your password encrypted—so even we can’t see it.
Here’s something to keep in mind: posting a public review or picture for Modishbear means your name goes live too. Other people can see it; therefore, keep this in mind, like if you’d rather keep it private or public, In case you have any query regarding this, send an email so that we can look into it and make changes if needed
A brief note regarding payments. Your payment is made through Shopify Payments or another provider of your choosing, like PayPal, Apple Pay, or the major card networks. The store is powered by Shopify. You type your card number straight into the payment provider's secure system. We never see or store the full number. What we do see is the sort of thing on a receipt: the billing name, the card type, the last few digits, and whether the payment is cleared.
2.2 Things We Pick Up Automatically
The moment you land on the site, some information gets noted in the background by cookies and similar tools. You don't type any of it in. It's your IP address and rough location, like the city or state you're in. It's the device, browser, and operating system you're using. And it's a trail of what you did: the pages you opened, the products you searched for, how long you stayed, and any error or crash along the way.
We use this to keep the store running, keep it secure, and work out what shoppers actually like so we can do better. There's more on cookies further down.
2.3 Things We Get from Elsewhere
We may occasionally receive information about you from sources other than our own website, and these may include Facebook, Instagram, and TikTok, which may send us the basic profile information you have consented to share if you log in or communicate with us through these platforms.
Our couriers and fulfilment partners send us delivery updates and confirmed addresses. Our payment and fraud checks come back with a result. And our advertising and analytics partners tell us, how our ads are doing.
We put these pieces together, so we hold one accurate picture of you rather than a scattered one.

3. Why We Use It
We only use your information for reasons that fit running our e-commerce site.
The big one is getting your order to you. We need your details to take payment, pack the right items, ship them to the right place, keep you posted with order and tracking updates, and sort out any return, refund or warranty claim later on.
If you've made an account, we use your information to keep it working, let you sign in, and show you your orders and saved items. When you get in touch with a question or a problem, we use it to find your order and actually help you.
We also look at how the store gets used so we can fix what's broken, stock what people want, and make the whole thing less annoying to shop on. We keep proper business and accounting records too, because we have to.
Some of it is about safety. We use your information to catch fraud, fake orders, and payment abuse before they cause trouble.
And some of it is marketing. If you've opted in where the law asks us to, we'll email or text you about new products, sales and offers, and we'll show you ads on other sites and social platforms based on what you've looked at. You can switch the marketing off any time, and you can visit section 7 in this privacy policy to know how.
Now and then the law makes us hold on to information, or hand it over, to meet a tax rule or answer a valid request from a regulator or court.
Under the Australian Privacy Principles, we're allowed to do all this because it's reasonably necessary to run the business, because you've agreed to it, or because the law requires it.

4. Who Else Sees It
We don't sell your personal information. We share it with the companies that help us run the shop, and only as far as each one needs to do its job. Those are:

There are also times we may have to disclose your information whether we'd choose to or not: to follow the law or a court order; to protect the safety or property of Modish Bear, our customers or the public; or to look into fraud or a breach of our terms. If the business is ever sold, merged or restructured, your information may pass to the new owner, who would have to honour the same protections set out here.

5. Sending Information Overseas
Because we lean on global services like Shopify, Google and Meta, some of your information ends up stored or handled outside Australia, often in the United States or parts of Europe. Privacy laws in those places aren't always the same as ours.
Whenever your information leaves Australia, we take reasonable steps to keep it protected to a standard that lines up with the Australian Privacy Principles, mainly by using providers who commit to proper data handling terms. If you're in the European Economic Area or the United Kingdom, we rely on approved safeguards such as the Standard Contractual Clauses for those transfers.

6. Cookies and Tracking
A cookie is a small file a website saves on your device when you visit. They're everywhere on the web, and we use them along with similar tools like pixels and tags. Here's what ours do.
Some are simply essential. They remember what's in your cart, keep you logged in, and keep checkout secure. The store can't run without them, so there's no switching these off.
Others remember your preferences, like your region or the items you looked at last, so you don't have to set them again. They make the shop nicer to use, but you could live without them.
Then there are the analytics cookies. These count visitors and show us which pages and products people go for, which is mostly Google Analytics doing its thing. The data is grouped, so it isn't used to single you out personally.
Last are the advertising cookies. These let us and partners like Meta, TikTok and Google show you ads that suit you better and check whether those ads are working. Turn them off and you'll still see ads, just ones that are more random.
You're in charge of cookies. Most browsers let you block or delete them in the settings, and many will warn you before one is set. Just know that if you block the essential ones, parts of the store, checkout included, may stop working. Our site doesn't currently respond to browser "Do Not Track" signals. 7. Marketing and How to Stop It
If you've signed up, we'll send you emails or texts about new products, sales, and offers. You can pull the plug whenever you like. Click "unsubscribe" at the bottom of any marketing email, reply STOP to a marketing text, or just email us and ask. Once you've opted out, the marketing stops. You'll still get the messages tied to an actual order, like a shipping confirmation, because those aren't marketing; they're us keeping you informed.
You can also tidy up the ads you see on Facebook and Instagram in your settings on those platforms.

8. Keeping Your Information Safe
Security matters here. Your data gets protection through practical tech steps and smart setup choices. Hosted on Shopify, our e-commerce website ensures well-configured measures ensure that info moving between systems stays encrypted. Payment handling happens via services compliant with PCI rules (Payment Card Industry Data Security Standard), and only staff required to handle private details can reach them.
We can't promise the impossible, though. No website or internet connection is ever completely safe, and there's always some risk in sending information online, which you accept when you do. A few things help on your end: keep your password private and strong and keep your own device and software up to date.
If a data breach ever happens that's likely to cause you serious harm, we'll tell you and we'll notify the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.

9. How Long We Keep It
We hang on to your information only as long as there's a real reason. In practice that's usually for as long as you have an account or keep shopping with us, plus a stretch afterwards. The reasons are similar to what most online stores have: finishing and supporting your orders, dealing with returns and warranties, keeping the accounting and tax records the law makes us keep, and sorting out the odd dispute.
When none of that applies any more, we either delete your information or strip out anything that ties it back to you.

10. Your Rights
You get a proper say over your information. Under Australian privacy law, you can ask us to:

Plenty of this you can do yourself without emailing anyone. If you've got an account, you can log in and fix your name, address, or contact details directly, and you can unsubscribe from marketing from any email we send. For everything else, or if you don't have an account, the request route below is the way to go.
To ask for any of these, email us with "Privacy Request" in the subject line. So we know it's really you, we may ask you to confirm a few details we already hold before we act. We'll respond to you in a timely manner—typically within 30 days—and it's usually free. We may charge a reasonable fee or, in rare cases, refuse a request if it is obviously excessive or keeps coming up, and we will always let you know why.
The GDPR gives you additional rights if you reside in the UK or the European Economic Area, such as the ability to restrict or object to specific uses of your data and the ability to carry a portable copy with you.
According to the CCPA, you have the right to know what we collect, to have it removed, and to refuse any "sale" or "sharing" of it if you live in California. The site links out to plenty of other places: our pages on Instagram, Facebook, TikTok and X, and now and then other companies' sites. Once you click through or use a social "share" button, those sites handle your information under their own policies, not this one. We don't run them and we can't answer for them, so it's worth reading their policies before you hand anything over.

12. Children
ModishBear is designed and created to offer products for adults; neither our store nor our products are intended for children, and we don't intentionally collect anything from anyone younger than sixteen. Please don't provide us with your information if you are younger than 16 unless your parent or legal guardian gives their consent. If we discover that we have gathered a child's information without that, we will promptly remove it. Send us an email right away with the subject line "Children's Privacy" if you believe a child has given us their information.

13. Changes to This Policy
As our e-commerce store grows and the rules shift, we'll update this page from time to time. When we do, the new version goes up here, and the "Last updated" date at the top changes with it. If a change is a big one, we'll make more of an effort to flag it, with a notice on the site or, where the law says we must, a message to you directly. Worth a glance now and then, so nothing catches you out. Keep using the site after a change, and you're accepting the updated version.
